Biography

Meagan has developed a broad knowledge of environmental laws and regulations and advises her clients on ways to avoid or eliminate environmental issues that could prevent them from reaching their corporate growth goals.  As a partner at Brouse McDowell, she provides regulatory compliance support to the firm’s industrial and municipal clients in matters relating to water, air, solid waste, and hazardous waste, and when compliance issues escalate she has successfully negotiated with state and federal agencies to resolve enforcement matters to her clients' benefit.

Meagan also has experience in assisting clients in reducing exposure to environmental liabilities in corporate and real estate transactions. She works with clients, whether buying or selling companies or pieces of real estate, to achieve a clear picture of potential environmental liabilities at issue, and then works to draft and negotiate contract language to minimize environmental risks. She also has experience in securing environmental liability insurance for clients that desire the additional financial protection such insurance offers. In real estate matters, Meagan has worked with clients to secure the purchase of blighted property and has been actively involved in moving many such sites through Ohio's Voluntary Action Program.

  • Representative Engagements
    • Counsel county solid waste management district in matters related to drafting and negotiating waste agreements, drafting and approval of waste plan, and securing property and development of waste facilities within county
    • Represent private centralized wastewater treatment facility in matters related to environmental compliance, permitting and enforcement, including industrial wastewater discharge permits, air permits, and alleged violations of hazardous waste rules
    • Represent PRPs in connection with remediation conducted pursuant to the Great Lakes Legacy Act, and related claims for natural resource damages under CERLCA
    • Represent major oil company in connection with negotiating remediation under Ohio’s Voluntary Action Program of prior refinery site with current owner of property
    • Represent waste management company in negotiating waste disposal agreement with third party
    • Successfully negotiate with Ohio Environmental Protection to reduce penalty for allegations against waste management company for solid waste handling violations
    • Review and update city regulations addressing environmental matters such as clean air regulations, water pollution, and asbestos
    • Assist clients with handling of hazardous materials to ensure compliance with state, federal and international laws
    • Conduct pro bono work for the Cleveland Port Authority to ensure regulatory compliance
    • Successfully negotiate with state and federal environmental agencies to reduce and eliminate potential penalties for violations discovered pursuant to facility wide environmental compliance audits
    • Negotiate transfer and indemnification of environmental liabilities in purchase agreements
    • Successfully defended client in Ohio Environmental Review Appeals Commission proceeding involving penalties related to the removal of underground storage tanks
    • Counsel local townships and municipalities during negotiations with solid waste disposal companies.
    • Assist clients in obtaining grant funding for remedial investigations of newly acquired property and navigating Ohio's Voluntary Action Program.
