Biography

Irv is a partner in Brouse McDowell’s Real Estate and Litigation Groups. His practice includes all facets of land use planning, zoning, economic development, real estate, and business litigation. Through his years of litigation and trial practice, Irv has become a leader in governmental law and litigation, as well as mediation and alternative dispute resolution.

Irv serves as the law director/solicitor for five political subdivisions; Copley, Springfield, and Coventry Townships; and the Villages of Lakemore and Lodi. He also regularly represents many other Northeast Ohio political subdivisions as special counsel. Prior to joining Brouse McDowell, Irv served as Managing Partner for a local law firm. He has also served as the Adjunct Professor of Negotiations at The University of Akron.

    • Irv is a frequent lecturer in the areas of zoning, land use, economic development, negotiations, mediation, and various topics involving real estate. He has made presentations to and taught seminars for the Akron Bar Association, the Cleveland Metropolitan Bar Association, The University of Akron School of Law, and the Ohio Township Association.
  • Representative Engagements
    • Served as special counsel to the cities of Green, Barberton, Fairlawn, Norton (Interim Law Director), the Townships of Bath, Twinsburg, Franklin and Chippewa, and the Villages of Lakemore, Reminderville and Hartville
    • Served as general counsel to the Chapter 7 Trustee in In re: Arter & Hadden, a now defunct 160 year old Cleveland law firm that declared bankruptcy in 2004
    • Coordinated and served as lead counsel in over 140 adversary proceedings against former clients of Arter & Hadden, and all adversary litigation involving the firm's secured lenders
    • Secured an $11 million dollar settlement against the former partners of Arter & Hadden, and their insurance carriers
    • Represented a consortium of insurance companies in the defense of a complex multi-million dollar legal malpractice claim
    • Successful defense as co-counsel to NBA star LeBron James in a $15 million dollar claim in Summit County Court of Common Pleas
    • Negotiated the first Joint Economic Development Districts in the State of Ohio with the City of Akron on behalf of Coventry and Springfield Townships
    • Represented MetroParks, Serving Summit County in litigation and administrative proceedings in the U.S District Court and before the Sixth and District of Columbia Circuit Court of Appeals, and the Federal Energy Regulatory Commission, successfully defeating efforts to construct a hydro-electric plant in the Gorge Metro Park
    • Martin v. Design Construction – served as co-counsel in a case before the Ohio Supreme Court which established the measure of damages in a breach of contract suit by a homeowner against a contractor; The Court reversed a decision by the Ninth District Court of Appeals in a unanimous decision that was a victory for homeowners and consumers statewide.     • Copley Township vs. Pearson- Obtained a permanent injunction against the owner of over 90 exotic animals and coordinated the rescue and relocation of the animals to sanctuaries across the United States
    • State of Ohio vs. Antonio Brooks- Represented Antonio Brooks in having his death sentence vacated by the Ohio Supreme Court, State v Brooks (1996), 75 Ohio St. 3d 148
