Update: Ohio's Price-Transparency Statute Litigation

Brouse McDowell has been closely monitoring Ohio’s implementation of a controversial price-transparency statute. In our last update regarding the pending lawsuit Community Hospitals and Wellness Centers, et al. v. State of Ohio, which is currently blocking the statute’s implementation, we reported that a preliminary injunction hearing was scheduled to take place on March 17th. Last week, the Williams County Common Pleas Court rescheduled the hearing for August 14, 2017. The court also set a briefing schedule, with the first brief due July 17, 2017 that will provide further details of the State’s legal arguments in support of implementing the statute. The court’s rescheduling order ensures that no implementation or enforcement of the statute can occur until it rules on the motion for preliminary injunction. We will continue to monitor the case and let you know of further developments.
