Brouse McDowell Achieves Summary Judgement in Federal Court for Mercy St. Vincent Medical Center in Toledo, Ohio

After four years of extensive litigation, in a case where the plaintiff initially demanded $30 million and claimed to have incurred fees approaching $2 million, a team of Brouse McDowell attorneys was awarded Summary Judgement for Mercy St. Vincent Medical Center in Toledo, Ohio. U.S. District Judge James G. Carr Sr. granted Summary Judgement on all six counts in favor of Mercy and against a former highly paid heart surgeon assigned to the hospital.
The essence of the case is the surgeon alleged he was the victim of reverse racial and national origin discrimination in how referrals were made to him. The Court ruled that Mercy cannot be held liable for employment discrimination based on referral decisions by independent, third- party cardiologists.
